AER Publishes Embedded Network Review Draft Decision - March 2025

March 28, 2025

On 17 March 2025, the AER released the Review of the AER exemptions framework for embedded networks Draft Decision along with proposed amendments to the Network Exemptions Guideline and the Retail Exempt Selling Guideline. While the AER proposes guideline amendments to resolve some identified gaps, the Draft Decision recognises that comprehensive reform, requiring joint action from jurisdictional governments, is essential to address issues beyond the AER's regulatory scope. The next steps for stakeholders would be to consider if the guidelines apply to them, to have a compliance audit done, and/or make a submission on the draft guidelines. Victoria's electricity market underwent significant changes following the Victorian Government’s Embedded Networks Review, resulting in the introduction of the General Exemption Order 2022 (GEO 2022). Following this update for Electricity in Embedded Networks, a Gas Embedded Networks General Exemption Order (GEN GEO) has now been issued for the supply of gas within existing gas embedded networks, under the Gas Industry (GI) Act (GEN GEO 2025), effective February 25, 2025.

Whereas customers within the National Electricity Market (NEM) zones of Southeast Queensland, NSW and South Australia are indirectly benchmarked –with the DMO acting as a price cap for the standing offer of the local area retailers.

ACT Government's Independent Review into Embedded Networks

The Australian Capital Territory (ACT) Government’s independent review, commissioned in 2022 has by contrast drawn on its findings to outline a path forward within the state that utilises the benefits of embedded networks for customers. AER Issues Paper on Embedded Networks within the NEM

Victorian Government Publishes Updated General Exemption Order

October 10, 2022

On the 29th of September, the Victorian Government published an update to the General Exemption Order (GEO). This update falls within the first phase of reforms into the ban on new Embedded Networks in residential apartment buildings, taking effect from 1 January 2023. Captured within the update are new conditions of exemption for all new Embedded Networks with 10 or more customers in the VR2 exempt category.
